1. General provisions

1.1. These Terms of Sale (hereinafter – the Terms) determine the rights, responsibilities and duties of the Buyer and “esviesa.lt” (hereinafter referred to as “the Seller”) to the Buyer when purchasing goods on our site.

2. The moment of the conclusion of the purchase and sale contract

2.1. The Purchase and Sale agreement between the Buyer and the Seller is considered to be concluded from the moment when the Buyer has formed a basket of goods in the electronic shop, indicating the delivery address, choosing the payment method and familiar with these conditions, ordering the goods, and valid until the full performance of the obligations under this agreement.

2.2. Each contract concluded between the Buyer and the Seller is stored in the “esviesa.lt” database.

3. Buyer’s rights

3.1. The Buyer has the right to purchase goods in the e-shop, in accordance with these Terms and the legal acts established by the Republic of Lithuania.

3.2. The Buyer has the right to refuse the Purchase and Sale Agreement with the Seller by notifying the Seller in writing within 7 business days from the date of delivery of the goods. The Buyer has the right to refuse the Purchase and Sale Agreement with the Seller only if the product has not been damaged and its appearance has not changed substantially.

4. Buyer’s responsibilities

4.1. The buyer must accept ordered goods and pay the price of the goods and their delivery.

4.2. The goods chosen by the buyer are reserved and the Seller undertakes to execute the purchase agreement only when the Seller receives payment for the selected goods. The buyer must confirm the payment order no later than within 24 hours after the order is made. Within this time limit without confirming the payment order, the Seller has the right to consider that the Buyer has waived the purchase and sale agreement.

4.3. The Buyer must comply with the requirements of other Conditions and the legal acts of the Republic of Lithuania.

5. Seller’s rights

5.1. If the Buyer attempts to damage the electronic stores to work or operate stably, the Seller may be subject to an early warning restriction, to suspend (terminate) his access to the electronic store.

5.2. The seller has the right to terminate the activity of the e-shop temporarily or indefinitely by a separate notice.

5.3. The Seller has other rights provided for in the Conditions and the legal acts of the Republic of Lithuania.

6. Seller’s duties

6.1. To enable the buyer to properly use the services provided by e-shops.

6.2. To arrange delivery of goods ordered by the Buyer at the address indicated by the Buyer.

6.3. The seller, in the event of unforeseen circumstances and inability to supply the goods ordered to the buyer, undertakes to offer a similar item to the Buyer, and if the Buyer refuses to accept the analogue, return the amounts paid to the buyer within 10 business days. In this case, the Seller is exempted from liability for the non-delivery of goods.

7. Delivery of goods

7.1. Goods The buyer’s account is presented by “esviesa.lt” transport or other transport company. In the cases specified by the Seller, the goods are presented at Seller’s expense.

7.2. Goods are delivered to the address indicated by the Buyer within 1-7 business days from the payment received for the goods and transportation of the goods, unless the next delivery date is specified. Delivery of goods is carried out worldwide.

7.3. The exact shipping price depends on the weight, volume, size and delivery location of the goods you are ordering, so you will see the final price only after you have completed the order and received a confirmation of the order. You can view the prepayment prices in the Shipping section.

7.4. During the delivery of the item, the Buyer must check with the representative of the transport company the condition of the consignment, quantity, quality and range of goods.

7.5. Having noticed the violation of the consignment, the non-conformity of the quantity, quality, assortment of goods, the Buyer must not accept the consignments and this is indicated in the consignment note. Upon acceptance of the consignment by the buyer and signature of the consignment note without comments, the consignment is deemed to be defective, the quantity, quality and assortment of the goods are in conformity with the terms of the purchase and sale agreement.

7.6. Goods are handed over to the receiving person upon presentation of a personal identity document. If the goods are accepted by the Buyer, the Buyer is obliged to specify the details of the person accepting the goods by filling in the order delivery information as regulated by the Law on Legal Protection of Personal Data of the Republic of Lithuania (Official Gazette, 1996, No. 63-1479).

8. Return of goods

8.1. If the Buyer (user) renounces the Purchase and Sale Agreement as provided for in Clause 3.2 of the Terms, the Goods are returned to the Seller’s Account within 7 days from the receipt of the Buyer’s Letter of Understanding on the waiver of the Purchase and Sale Agreement. Things that the buyer / consumer does not like is the form, size, color, pattern or complexity (except for exemptions provided for in the legal acts of the Republic of Lithuania), are changed or accepted from the Buyer within 14 days from the delivery date.

8.1.1. Goods are returned in the original package of goods and items. Returns must be accompanied by the original invoice you receive with the item.

8.1.2. The buyer is responsible for completing and packing the item. If the item is not complete and properly packaged, the Seller will not accept the item to be returned.

8.1.3. Goods will not be accepted back if used and / or damaged and / or lost in appearance (changes in the appearance of the product or its packaging that were necessary to inspect the product are not considered to be essential changes to the appearance of the item).

8.2. If the delivered item does not meet the quality requirements, the Buyer has the right to apply to “esviesa.lt” for the repair of the goods, the return of the goods or the use of the discount for the brokered product.

9. Responsibility

9.1. The buyer is responsible for the accuracy of the data provided in the registration form. The buyer assumes responsibility for the consequences of the mistakes or inaccuracies in the data submitted in the registration form.

9.2. The parties are liable for the violation of the purchase and sale agreement concluded using the electronic shop in accordance with the procedure established by legal acts of the Republic of Lithuania.

9.3 Taking into account Article 8 of the Law on Electronic Signature of the Republic of Lithuania. 3 d the Buyer agrees with the Seller that the confirmation of the Customer’s actions in the e-shop for the access to the e-shop data (identification code) is subject to Article 8 of the Electronic Signature Act. 1 d the legal validity of the electronic signature (i.e., has the same legal validity as the signature in the written documents and is permissible as a means of proof in court). The buyer must keep his / her access to the e-shop data and not to disclose it, ensure that the data is known only to him and the data is used only by himself, not transmitted and otherwise not make it possible for other persons to access or use those data. In case of suspicion that the login data may have been discovered by another person, immediately notify the Seller thereof, as well as immediately inform the Seller about the violation or disclosure of the access to the online store. All actions performed using the Buyer’s Identification Code are deemed made by the Buyer and the Buyer assumes full responsibility for the consequences of such actions.

9.4. The Seller is not liable for the information provided on the websites of other companies, even if the Buyer goes to these websites through the links in the Seller’s online store.

9.5 In case of damage, the damaged party compensates for direct losses incurred to the other party.

10. Sending information

10.1. The seller sends all messages to the e-mail address provided by the Customer registration form.

11. Final provisions

11.1 All disputes arising out of or relating to the purchase and sale agreement between Buyer and Seller are negotiated. Failing to reach an agreement, disputes are resolved in accordance with the procedure established by legal acts of the Republic of Lithuania, determining the jurisdiction in accordance with the Seller’s seat.
